Welcome to MemberSure.

These Terms & Conditions govern your access to and use of the MemberSure website and related online services.

MemberSure is a product of:

BOMANDA GENERAL TRADING (Pty) Ltd
Trading as MemberSure

By accessing or using this website, you agree to comply with these Terms & Conditions. If you do not agree with these Terms, please do not use the website.


1. ABOUT MEMBERSURE

MemberSure is a technology platform designed to assist funeral parlours with business administration and membership management.

The MemberSure platform may provide functionality including:

  • Member management
  • Funeral policy management
  • Premium payment recording and tracking
  • Digital receipts
  • Beneficiary and dependant management
  • Reports and analytics
  • User and branch management
  • Communication tools
  • Other software features and services offered by MemberSure from time to time.

MemberSure is a software and technology service provider.

MemberSure is not an insurance company, insurer, underwriter, funeral insurance provider or financial services provider merely by providing the software platform.

The funeral parlour remains responsible for the funeral products, policies and services that it offers to its own customers.


2. WEBSITE USE

You may use this website for lawful purposes only.

You agree not to:

  • Use the website for unlawful purposes;
  • Attempt to gain unauthorised access to the website or systems;
  • Interfere with the operation or security of the website;
  • Introduce malicious software or harmful code;
  • Attempt to access another person’s account;
  • Copy, reproduce or exploit website content without permission;
  • Misrepresent your identity or relationship with MemberSure; or
  • Use the website in a manner that could damage MemberSure or its customers.

MemberSure reserves the right to restrict or terminate access to the website where reasonably necessary to protect the website, its users or its business.


3. WEBSITE CONTENT

We make reasonable efforts to ensure that information published on the website is accurate and useful.

However, website content is provided for general informational purposes and may change from time to time.

MemberSure does not guarantee that:

  • All information will always be complete;
  • All information will always be current;
  • The website will always be available;
  • The website will always be free from errors; or
  • Every feature described on the website will be available at all times.

Product features, services and future developments may change without notice.


4. SOFTWARE FEATURES AND FUTURE PRODUCTS

MemberSure may display products, features or services that are:

  • Currently available;
  • Under development;
  • Coming soon; or
  • Future product concepts.

Where a feature is identified as “Coming Soon”, “Future Vision” or similar wording, that feature is not necessarily currently available for purchase or use.

MemberSure does not guarantee that a future product, feature or service will ultimately be released or released in the form shown on the website.


5. DEMONSTRATIONS AND ENQUIRIES

Visitors may request a demonstration or contact MemberSure through forms, email, telephone, WhatsApp or other available communication channels.

Submitting an enquiry does not create a subscription or contractual relationship.

A MemberSure representative may contact you using the information supplied in your enquiry.

Any subscription to the MemberSure software will be subject to the applicable MemberSure Software Subscription Agreement and other applicable terms.


6. SOFTWARE SUBSCRIPTIONS

If you become a MemberSure customer, your use of the MemberSure software platform will be governed by the separate MemberSure Software Subscription Agreement entered into between MemberSure and the funeral parlour.

The subscription agreement governs matters including:

  • Subscription fees;
  • Payment terms;
  • Suspension;
  • Cancellation;
  • Customer Data;
  • Data retention;
  • Data export;
  • Intellectual property;
  • Customer responsibilities;
  • Password security;
  • Support;
  • Liability; and
  • Other matters relating to the software service.

Where these website Terms & Conditions conflict with the signed Software Subscription Agreement in relation to the customer’s paid software subscription, the Software Subscription Agreement will take precedence.


7. INTELLECTUAL PROPERTY

Unless otherwise stated, the content and materials appearing on the MemberSure website are owned by or licensed to MemberSure.

This may include:

  • MemberSure branding;
  • Logos;
  • Names;
  • Text;
  • Graphics;
  • Images;
  • Videos;
  • Website designs;
  • Software demonstrations;
  • Interface designs;
  • Icons;
  • Marketing materials; and
  • Other website content.

You may not reproduce, modify, distribute, sell, commercially exploit or create derivative works from MemberSure content without prior written permission.

Nothing on this website grants you ownership of MemberSure’s intellectual property.


8. MEMBERSURE SOFTWARE

The MemberSure software platform, including its underlying technology, design, source code, functionality, databases, interfaces and related intellectual property, remains the property of MemberSure or its applicable licensors.

Customers receive a limited right to use the software in accordance with their applicable subscription agreement.

Customers do not acquire ownership of the MemberSure software by subscribing to or using the platform.


9. CUSTOMER DATA

Funeral parlours using MemberSure may enter and manage their own business and member information through the platform.

The funeral parlour remains responsible for the information it enters into the system.

MemberSure does not claim ownership of Customer Data.

The processing of Customer Data is addressed further in the MemberSure Privacy Policy, POPIA & Data Protection Notice, and the applicable Software Subscription Agreement.


10. PRIVACY AND PERSONAL INFORMATION

MemberSure respects the privacy of individuals.

Personal information submitted through the website may be processed for purposes such as:

  • Responding to enquiries;
  • Arranging demonstrations;
  • Providing requested information;
  • Managing customer relationships;
  • Providing services;
  • Communicating service information; and
  • Complying with applicable legal obligations.

  • Circumstances outside MemberSure’s reasonable control.

If you submit information through a MemberSure form or communication channel, you confirm that the information you provide is accurate to the best of your knowledge and that you are authorised to provide it.

You should not submit confidential information that MemberSure has not requested through an appropriate secure channel.


16. WEBSITE SECURITY

Users must not attempt to compromise or bypass the security of the MemberSure website.

This includes attempting to:

  • Gain unauthorised access;
  • Access restricted areas;
  • Circumvent authentication;
  • Introduce malicious code;
  • Interfere with servers;
  • Probe or scan systems without authorisation; or
  • Access information belonging to another user.

Any suspected security issue should be reported to MemberSure.


17. LIMITATION OF LIABILITY

To the extent permitted by applicable law, MemberSure will not be responsible for losses arising directly from your use of, or inability to use, the website where such loss results from circumstances outside MemberSure’s reasonable control.

  • Hosting interruptions;
  • Power failures;
  • Cybersecurity incidents;
  • Technical failures;

  • Other circumstances beyond MemberSure’s reasonable control.

Nothing in these Terms & Conditions is intended to exclude or limit any liability that cannot lawfully be excluded or limited under applicable South African law.


18. NO GUARANTEE OF BUSINESS RESULTS

MemberSure provides technology intended to assist funeral parlours with administration and business management.

However, MemberSure does not guarantee:

  • Increased membership;
  • Increased revenue;
  • Increased profitability;
  • Reduced operating costs;
  • Increased customer retention; or
  • Any particular business outcome.

Business results depend on factors outside MemberSure’s control, including how the funeral parlour uses the platform and manages its business.


19. ACCEPTABLE USE OF MEMBERSURE

You agree to use MemberSure’s website and services responsibly and lawfully.

You must not use MemberSure to:

  • Store unlawful content;
  • Commit fraud;
  • Violate another person’s rights;
  • Attempt to access information without authorisation;
  • Misuse another person’s personal information;
  • Circumvent security controls; or
  • Conduct activities that could damage MemberSure’s systems or reputation.

MemberSure may take reasonable steps to protect its systems and users where misuse is suspected.


20. CHANGES TO THESE TERMS

MemberSure may update these Terms & Conditions from time to time.

Changes may be made to reflect:

  • Changes to the website;
  • New services;
  • New technology;
  • Changes in legal requirements;
  • Security improvements; or
  • Changes to our business practices.

The updated version will be published on the website with a revised “Last Updated” date.

Your continued use of the website after an updated version is published constitutes acceptance of the updated website Terms & Conditions, to the extent permitted by applicable law.

Nothing in these Terms & Conditions is intended to remove or limit any rights or protections that a person may have under applicable South African law.


23. SEVERABILITY

If any provision of these Terms & Conditions is found to be unlawful, invalid or unenforceable, that provision will be interpreted or limited to the extent necessary, and the remaining provisions will continue to apply to the extent permitted by law.


24. ENTIRE WEBSITE TERMS

These Terms & Conditions, together with the applicable Privacy Policy and POPIA & Data Protection Notice, constitute the general terms governing use of the MemberSure website.

For paying funeral parlour customers, the separate MemberSure Software Subscription Agreement governs the contractual subscription relationship.
