BOMANDA GENERAL TRADING (Pty) Ltd trading as MemberSure (“MemberSure”, “we”, “us” or “our”) respects your privacy and is committed to protecting your personal information.

  • Contact us;
  • Request a demonstration;
  • Enquire about our products or services;
  • Subscribe to or use the MemberSure platform; or
  • Otherwise interact with MemberSure.

MemberSure operates in South Africa and aims to process personal information in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA) and other applicable laws.


1. INFORMATION WE COLLECT

Depending on how you interact with MemberSure, we may collect information such as:

  • Name and surname
  • Telephone number
  • WhatsApp number
  • Email address
  • Business or funeral parlour name
  • Business address

Enquiry and Demo Information

When you request a demonstration or contact us, we may collect:

  • Funeral parlour name
  • Contact person’s name
  • Contact details
  • Number of members
  • Number of branches
  • Information about your business
  • Information provided in your enquiry

Account Information

If you become a MemberSure customer, we may process information required to create and administer your account, including:

  • User name
  • Email address
  • Contact information
  • Login credentials
  • User roles and permissions
  • Subscription information

Customer Data

Funeral parlours using MemberSure may enter information relating to their members, beneficiaries, dependants and policies into the platform.

Such information may include personal information belonging to individuals who are customers or members of the funeral parlour.


2. HOW WE USE PERSONAL INFORMATION

We may use personal information to:

  • Respond to enquiries;
  • Arrange product demonstrations;
  • Provide information about MemberSure;
  • Create and manage customer accounts;
  • Provide and maintain our software services;
  • Provide customer and technical support;
  • Process subscriptions and payments;
  • Communicate important service information;
  • Improve our software and services;
  • Maintain the security of our website and platform;
  • Detect and prevent misuse, fraud or security incidents;
  • Comply with applicable legal and regulatory obligations.

We will not use personal information for purposes that are incompatible with the purpose for which it was collected unless permitted or required by law.


3. FUNERAL PARLOUR CUSTOMER DATA

MemberSure provides software that allows funeral parlours to manage their own business and member information.

Where a funeral parlour enters personal information into the MemberSure platform, the funeral parlour is generally responsible for determining:

  • Why the information is collected;
  • What information is collected;
  • How the information is used; and
  • Whether the collection and processing of the information is lawful.

MemberSure provides the technology used to process and manage that information on behalf of the funeral parlour.

The funeral parlour remains responsible for ensuring that it has the necessary authority or lawful basis to collect and process information belonging to its members, beneficiaries and other individuals.


4. MEMBER DATA OWNERSHIP

Customer Data entered into the MemberSure platform remains the property and responsibility of the relevant funeral parlour.

MemberSure does not claim ownership of Customer Data.

MemberSure may process Customer Data only to the extent reasonably necessary to provide, maintain, secure and support the MemberSure services, or where otherwise permitted or required by law.


5. INFORMATION SHARED WITH US

You may voluntarily provide personal information when you:

  • Complete a contact form;
  • Request a demo;
  • Send an email;
  • Contact us by telephone;
  • Contact us through WhatsApp;
  • Request information about our services;
  • Become a MemberSure customer.

Please avoid submitting unnecessary sensitive personal information through public website forms.


6. COOKIES AND WEBSITE TECHNOLOGIES

The MemberSure website may use cookies and similar technologies to help:

  • Operate the website;
  • Remember preferences;
  • Understand how visitors use the website;

8. PAYMENT INFORMATION

Where payments are made for MemberSure services, payment transactions may be processed through third-party payment providers.

MemberSure may not directly store complete payment card information where the payment service provider handles the transaction.

Payment information may be processed in accordance with the privacy policy and terms of the applicable payment provider.


9. DATA SECURITY

MemberSure takes reasonable technical and organisational measures to protect personal information against:

  • Unauthorised access;
  • Unauthorised disclosure;
  • Loss;
  • Damage;
  • Unauthorised alteration;
  • Unlawful processing; and
  • Destruction.

However, no internet-based system can guarantee complete security.

Users are also responsible for protecting their account credentials and should immediately notify MemberSure if they believe that their account or password has been compromised.


10. PASSWORDS AND ACCOUNT SECURITY

Customers are responsible for maintaining the confidentiality of their MemberSure usernames and passwords.

Customers should:

  • Keep passwords confidential;
  • Avoid sharing login details;
  • Use appropriate passwords;
  • Restrict system access to authorised users;
  • Remove access when a user is no longer authorised; and
  • Notify MemberSure of suspected unauthorised access.

MemberSure will not knowingly ask users to provide their passwords through unsecured communication channels.


11. DATA RETENTION

MemberSure retains personal information only for as long as reasonably necessary for the purposes for which it was collected, to provide the services, comply with legal obligations, resolve disputes and enforce agreements.

For Customer Data associated with a cancelled MemberSure subscription, the applicable retention period is generally 60 days, subject to the Customer’s agreement with MemberSure.

Customers may request an applicable data export during the permitted retention period.

After the applicable retention period, information may be securely deleted or anonymised, subject to legal or operational requirements.


12. DATA EXPORT

A funeral parlour that cancels its MemberSure subscription may request one free export of its Customer Data within the applicable 60-day retention period, in accordance with the MemberSure Software Subscription Agreement.

Customers are responsible for requesting and securely storing their exported information.


13. MARKETING COMMUNICATIONS

MemberSure may use contact information to communicate with prospective or existing customers about:

  • Product information;
  • Demonstrations;
  • Service updates;
  • New features;
  • MemberSure products and services;
  • Special offers or announcements.

Where required by law, appropriate consent or other lawful grounds will be relied upon.

You may request that we stop sending you marketing communications, subject to applicable legal requirements.


14. YOUR PRIVACY RIGHTS

Subject to applicable law, individuals may have rights regarding their personal information, including the right to:

  • Request access to personal information;
  • Request correction of inaccurate information;
  • Request updating of information;
  • Object to certain processing;
  • Request information regarding the processing of their personal information; and
  • Lodge a complaint regarding the processing of personal information.

Where MemberSure is processing information on behalf of a funeral parlour, requests relating to that member’s information may need to be directed to the relevant funeral parlour.


15. REQUESTING ACCESS TO YOUR INFORMATION

If you would like to make a privacy-related request concerning personal information held directly by MemberSure, you may contact us using the details provided below.

We may require sufficient information to verify your identity before processing certain requests.

Requests will be handled in accordance with applicable legal requirements.


16. PERSONAL INFORMATION OF CHILDREN

MemberSure’s services are primarily intended for funeral parlours and their authorised users.

Where a funeral parlour processes personal information relating to children through the MemberSure platform, the funeral parlour is responsible for ensuring that such processing complies with applicable legal requirements.


17. CROSS-BORDER DATA PROCESSING

Some technology or service providers used by MemberSure may operate or store information outside South Africa.

Where personal information is transferred outside South Africa, MemberSure will take reasonable steps to ensure that applicable POPIA requirements relating to cross-border transfers are considered.


18. DATA BREACHES

MemberSure maintains procedures for identifying and responding to suspected security incidents.

Where MemberSure becomes aware of a security compromise involving personal information processed on behalf of a funeral parlour, MemberSure will take reasonable steps to investigate, contain and address the incident and notify the relevant customer where required.

Where legally required, the responsible party will be responsible for fulfilling its notification obligations to affected individuals and the Information Regulator.


19. LINKS TO THIRD-PARTY WEBSITES

The MemberSure website may contain links to third-party websites or services.

MemberSure is not responsible for the privacy practices, content or security of third-party websites.

We recommend reviewing the privacy policy of any third-party website before providing personal information.


20. CHANGES TO THIS PRIVACY POLICY

MemberSure may update this Privacy Policy from time to time to reflect:

  • Changes to our services;
